Hoeven, locally known as D’Oeve, is a lively village with approximately 7,000 inhabitants and is part of the municipality of Halderberge in West Brabant. Asbestos Clause
For homes built before 1 July 1993, it was common practice to use asbestos-containing materials in, among other things, flues, roof structures, partition walls, façade panels, near heating and hot water installations, and floor coverings. The buyer acknowledges that asbestos-containing materials may be present.
The buyer is aware that any removal of asbestos-containing materials may require special measures under environmental legislation and indemnifies the seller against any liability arising from the presence and/or removal of asbestos from the property.
Age Clause
An age clause will be included in the purchase agreement because the property is more than 225 years old. This means that the construction quality standards may be considerably lower than those of newly built homes. The buyer cannot invoke non-compliance with current building regulations.
Industry-wide Measurement Instruction
The measurements have been established in accordance with an industry-wide measurement standard. This instruction aims to provide a more uniform method for indicating usable floor area. However, differences in measurement outcomes cannot be fully excluded due to interpretation differences, rounding or limitations during measurement. The principle remains: “what you see is what you buy,” and the property information is of subordinate importance.
Legally Valid Purchase Agreement Only After Signing
A verbal agreement between a private seller and private buyer is not legally valid. A legally binding sale only exists once both parties have signed the purchase agreement. This follows from Article 7:2 of the Dutch Civil Code. Confirmation of a verbal agreement by email or the sending of a draft purchase agreement is also not regarded as a legally valid agreement.
Deposit or Bank Guarantee
