Asbestos Clause
For homes built before July 1st, 1993, it was common practice to use materials containing asbestos in, among other things, chimneys, roof structures, partition walls, façade panels, and near heating and hot-water appliances. The buyer acknowledges that asbestos-containing materials may be present.
The buyer understands that the removal of asbestos requires special measures under environmental legislation and indemnifies the seller from liability arising from the presence or removal of asbestos.

Age Clause
The age clause will be included in the purchase agreement because the property is more than 120 years old. This means that the construction standards may be significantly lower than those of modern homes. The buyer therefore cannot rely on the property meeting current building regulations.

Seller Not Resident
The seller has not lived in the property and therefore cannot inform the buyer about characteristics or defects that would have been known had they lived there. This clause will also be included in the purchase agreement.

Legally Binding Agreement Only After Signing
A verbal agreement between a private seller and a private buyer is not legally binding. A purchase becomes legally valid only once both parties have signed the purchase agreement, as defined in Article 7:2 of the Dutch Civil Code. An email confirmation or draft contract does not constitute a legally binding agreement.

Deposit or Bank Guarantee
