Sales conditions
Asbestos clause
For homes built before July 1, 1993, there is a risk that asbestos-containing materials were used in (smoke) flues, roofing, partition walls, façade panels, near heating and hot water systems, and in flooring. The seller is aware of asbestos materials present (on the roof of the carport). Any risk associated with this passes to the buyer upon purchase and is recorded in the sales contract.
Age clause
Because the property is more than 55 years old, an age clause will be included in the sales contract. This means that the building quality requirements are considerably lower than those for new construction. Buyers cannot rely on the home conforming to current building regulations.
Measurement instruction NEN2580
The measurement instruction is based on NEN2580 to provide a uniform method for measuring usable floor area. However, differences in outcomes cannot be fully excluded due to interpretation, rounding, or measurement limitations. The principle remains: “what you see is what you buy” and the object information is of secondary importance.
Legally binding purchase agreement only after signing
A verbal agreement between a private seller and private buyer is not legally binding. A purchase is only valid once both parties have signed the contract, as required by Dutch Civil Code Article 7:2. Email confirmation or receiving a draft contract does not constitute a legally binding agreement.
Deposit or bank guarantee
Because Agnes Tomesen Makelaardij is a member of the NVM, the standard purchase contract is used as established by NVM, VBO, the Consumers’ Association, and the Homeowners’ Association. This contract requires a deposit or bank guarantee of 10% of the purchase price.
